How Is Fault Determined in a Personal Injury Case?

In most cases, the insurance companies are responsible for determining who is at fault when an accident occurs. They investigate and look at evidence, such as police reports, statements from the parties involved, black-box data, and photos of the accident scene. In complex cases where who is at fault isn’t clear, or the parties may share fault, they may also use accident reconstruction technology.

Can Victims Sue Even If They Were Partially at Fault?

Texas uses the modified comparative negligence rule, which means that a victim can file a lawsuit against the other party even if they were partially at fault. The requirement is that the victim be less at fault for the accident than the other party. The insurance companies generally determine the percentage of fault. For example, in the case of motor vehicle accidents, the insurance company may decide that driver A was 40 percent at fault while driver B was 60 percent at fault. In this case, driver A could sue driver B but not vice versa.

How Long Do You Have to File a Claim?

Most lawsuits have a statute of limitations. This is the time the law gives accident victims to file a court claim. If the victim doesn’t pursue compensation for their damages within this time limit, they forfeit the right to do so in the future. For most personal injury cases, the statute of limitations is two years, and the clock starts on the accident date. However, there are some exceptions. For example, in elder abuse cases, the timer can start when the abuse is discovered or should have reasonably been discovered. If the accident victim is a minor, they generally have until two years after they turn 18 to file a claim.

What Damages Are Included in Personal Injury Cases?

Accident victims can seek compensation for economic and noneconomic damages in personal injury cases. Economic damages are those that come with a specific, tangible number attached. For example, medical bills are clearly related to the injury and have a verifiable value. Lost wages are another example of an economic loss a victim may suffer if they cannot return to work immediately. Noneconomic damages are less tangible. Most people are familiar with the concept of pain and suffering, but this can also include damages for loss of enjoyment of life or loss of care and companionship in the case of a wrongful death claim.

Can You Get Workers’ Compensation and Still File a Lawsuit Against an Employer?

Texas law does not allow injured employees to recover both workers’ compensation benefits and personal injury damages from an employer. If you file for workers’ compensation, you will be forfeiting any claim you may have against the employer in a civil suit, except in rare cases of gross negligence. However, it may be possible to recover compensation from an employer if they do not provide workers’ compensation benefits. Injured workers may also file a lawsuit against a third party who was responsible for the accident, even if they received workers’ compensation.
